1. Community rules
The following rules and regulations are compulsory for all residents. The Resident understands and accepts the rules and regulations.
1.1 Assignment of the leased room
- The room is personal and non-transferable. The Resident may not sublet or assign the room or the rights and obligations of the Agreement.
- Inventory: on the first day, the Resident will receive a list of the furniture and equipment in the room. The Resident has 48 hours to confirm its accuracy. If the Resident does not do so, everything will be considered to be in good condition.
- The Resident must maintain the room, furniture and equipment in the same state of conservation as at the beginning. Modifications, holes, posters or other objects on the walls are not allowed.
- To change rooms, the Resident must inform the Owner. If there is a justified reason and it cannot be resolved, the change will be made as soon as possible according to availability, without affecting the rights of other Residents.
- The Owner may change the Resident to another room of equal or better condition for technical or operational reasons, such as maintenance or necessary adaptations.
- The Owner is not responsible for lost items not deposited in the lockers at the reception desk.
1.2 Maintenance of the room and the building
1.2.1 Resident's Obligations:
- Keep the facilities clean and in good condition.
- Accept to be transferred to another unit if requested by the Owner.
- Inform the Owner of any incident, allow access to the room for repairs, and pay for any damage caused. If the person responsible for damage in common areas is not identified, the cost will be divided among the residents of the affected area.
1.2.2 Owner's Obligations:
- Deliver the facilities clean and in good condition.
- Resolve incidents and carry out maintenance as soon as possible.
- Is not responsible for damage caused by Residents.
- Give notice before entering any room, except in emergencies.
1.3 Security
1.3.1 Electricity and hazardous materials:
- It is not allowed to install personal electronic devices (radiators, heaters, refrigerators, etc.).
- Cooking is not allowed in the Room, except in those equipped with a kitchen.
- It is forbidden to store or handle combustible, dangerous or flammable materials.
- The use of candles, barbecues, liquid gas, incense, etc. is prohibited.
- The Owner may remove prohibited objects and materials at any time.
1.3.2 Emergency exits and security systems:
- Do not block entrances, emergency exits or security systems.
- Emergency systems should only be used in emergencies.
1.3.3 Keys:
- Each Resident is responsible for his/her key, which is personal and non-transferable.
- In case of loss:
- Avisar al Propietario inmediatamente;
- El Residente paga el coste de la nueva llave;
- El Propietario no se responsabiliza por pérdidas, roturas o robos de llaves.
- La llave debe ser devuelta al final de la estancia; de lo contrario, el Residente asumirá los gastos correspondientes.
1.3.4 Windows, balconies, patio, terrace and roof:
- It is forbidden to throw or place objects through windows, balconies, terraces or roofs.
- Do not install external antennas.
- It is forbidden to hang laundry in these areas.
- Dangerous behavior such as hanging or jumping is prohibited.
1.4 Cleaning and recycling
1.4.1 Resident's Obligations:
- Keep the room and common areas clean and tidy.
- Share household chores and clean utensils and personal belongings in the kitchen area.
- Recycle garbage in the kitchen and street containers.
1.4.2 Owner's Rights:
The Owner may carry out daily inspections in the kitchen areas. If hygiene is unsatisfactory, Residents will receive a notification by email. If the situation is not corrected within 24 hours, cleaning staff will be hired and the cost will be divided among the Residents of the kitchen area. This cost will be communicated by email and must be paid within a maximum of 24 hours.
1.5 Noise
- Excessive noise is prohibited, as well as any activity that may disturb the peace of other occupants of the building.
- Silence must be observed between ten o’clock at night (22:00 hours) and eight o’clock in the morning (8:00 hours).
1.6 Guests and visiting hours
1.6.1 Visitors
- Visitors must be of legal age (over 18 years old).
- The Resident may receive visitors during the day, between 8:00 and 24:00 hours.
- Only one visitor per Resident is allowed at the same time.
- Visitors must register at the Reception both on entry and exit.
- Visitors must be accompanied by the Resident at all times.
- Residents are responsible for their visitors and their behavior in the building. Above all, it is the Resident’s responsibility that the visitor complies with the rules established by the Owner, particularly those established in this Agreement and in the Internal Rules of the Residence.
- Residents with a booking for one person, but whose room has a maximum capacity of two people, may receive one (01) guest, provided that the allowed capacity is not exceeded. It is the Resident’s responsibility to register the guest at reception prior to entry. Additionally, the Resident is responsible for the guest’s behavior within the building and must ensure that the guest complies with all rules set by the Owner, including those specified in this Contract and in the Residence’s Internal Regulations.
1.6.2 Overnight Guests
- Residents may receive overnight guests.
- Overnight Guests must be of legal age (over 18 years old).
- The Resident may only have one guest at a time for a maximum period of seven consecutive nights.
- Guests must register at reception upon arrival showing their passport/national identity document, and must be accompanied at all times by the Resident.
- Guests must check out at the reception desk and must be accompanied at all times by the Resident. Residents are responsible for their guests and their behavior. Above all, it is the Resident’s responsibility that the guest complies with the rules established by the Owner, particularly those established in this Agreement and in the Internal Rules of the Residence.
- The final check-out time will be 12:00 noon.
1.6.3 Owner's Rights
The Owner has the right to limit the right of entry of visitors and guests.
1.7 Supplies
The price of supplies is included in the rent. The Owner reserves the right to penalize any Resident who does not follow the energy saving rules established for the building.
1.8 Animals
The keeping of animals in the building is strictly prohibited.
1.9 Alcohol
Moderate consumption of alcohol is allowed in the facilities of LA FABRICA &CO. Notwithstanding the foregoing, Residents must behave properly at all times. Any inappropriate behavior under the influence of alcohol will be considered a VERY SERIOUS breach of our rules, the consequences of which include the immediate expulsion of the Resident from the residence.
1.10 Tobacco and drugs
1.10.1 Tobacco
Smoking is allowed inside the rooms, but may only be done in designated outdoor areas.
1.10.1 Drugs
The consumption, possession, entry and sale of drugs and any other type of drug trafficking in the building is prohibited.
1.11 Parties
The holding of parties in the building is strictly prohibited unless they are in designated spaces previously coordinated with La Fabrica &Co.
1.12 Bicycles
Bicycles are not allowed inside the building, except in designated areas.
1.13 Check-out
1.13.1 Keys:
The Resident must return the keys to his/her Room on the Check-out Date.
1.13.2 Check-out time:
- The Resident must notify the Owner of the exact date of departure, at least 15 days before the expiration of the Agreement, if such date is different from the one stipulated in the Agreement.
- The Resident must leave the room and the building on the final day provided for in his/her Agreement, or on an earlier date.
- The final check-out time will be 11:00 a.m. If the Resident has not left the building within the aforementioned period, the Owner may access the room without prior notice, empty it of any personal belongings of the Resident, and recover the use of the Room.
1.13.3 Cleaning and maintenance
- The cost of the cleaning service is forty-two euros (42-€), 21% VAT included. This amount will be paid at the beginning of the Agreement, even if the cleaning takes place at the end of the stay.
- After the Resident’s departure, the Owner will inspect the room and the kitchen area carefully, comparing it with the initial inventory signed by both parties at the beginning of the stay.
- The cost of repairing any defect detected will be deducted from the Deposit or charged directly to the Resident.
1.13. Personal belongings
The Resident must remove all his/her personal belongings from the room, kitchen area and common areas (including any food or drink in the cupboards or refrigerator).
The Owner will not be responsible for any personal belongings left in the room, kitchen area, or the building itself.
1.14 Rooftop/Pool
The Resident must comply with the pool hours established by the Owner (9:00 AM to 10:00 PM). The Resident must obey and adhere to the pool rules.
1.15 General
The purpose of the rules in this Agreement is to maximize the well-being of all Residents. If it becomes necessary to modify these rules for safety, hygiene, or welfare reasons, the Owner may do so and will notify the Residents. Failure to comply with the modified rules may result in penalties, depending on the severity of the violation.
Being a Resident implies accepting these rules and the Internal Regulations of the Residence, available at www.lafabrica-co.com. Residents must read and comply with these rules, which are part of the Agreement.
2. Penalties
2.1 Compliance
Any violation will be considered a breach of the Agreement and may result in legal penalties or expulsion imposed by the Owner. Any type of breach that causes damage will be remedied by the Resident. Any Resident found guilty of violating the rules of this Agreement or the Internal Regulations of the Residence will be required to pay the Owner for the amount of the fine or damages due to third parties as a result of the aforementioned violations.
2.2 Types of Violations
2.2.1 Minor Violations:
Non-compliance with any of the conditions specified in sections 1.3.2; 1.3.3; 1.3.4; 1.4.1; 1.5; 1.6.1; 1.6.2; 1.8 and 1.10.1 of the Agreement will be considered a minor violation.
2.2.2 Serious Violations:
- Repetition of a minor violation.
- Any breach of this Agreement that is not classified as minor or very serious.
- Any action that results in any type of material damage to third-party property up to €3,000.
2.2.3 Very Serious Violations:
- Repetition of a serious violation that may jeopardize the operation and good coexistence of the residence.
- Any action that causes any type of physical harm to people or material damage to third-party property exceeding €3,000.
- Any action that poses a danger to the health, safety, or physical integrity of individuals.
- Any action that constitutes a serious threat to the health, safety, or integrity of the building or third-party property.
- Any action classified as a serious, less serious, or minor crime under the current Spanish Penal Code.
- Any disrespect or insult to the residence staff.
- Two consecutive written warnings (as provided in Clause 3.2.4) within less than three months.
2.2.4 Warnings
- Minor violations will be sanctioned with written warnings from the Owner to the offending Resident, and in the case of repeated non-compliance, may result in the expulsion of the offending Resident.
- Serious violations will be sanctioned with written warnings to the offending Resident, and if the obligations are not met, this may result in the expulsion of the offending Resident.
- Very serious violations will be sufficient for the immediate termination of the Agreement and, consequently, the expulsion of the offending Resident. The Resident must leave the building within a maximum of 24 hours after receiving such a warning.
3. Notifications
Unless otherwise stated in the Agreement, notifications will be sent to the email address indicated in the reservation contract or in writing to the reception of LA FABRICA &CO residence. Both parties must inform each other of any changes to their email addresses.
4. Data protection
The information included in this Agreement has been provided by the Resident as mandatory, as it is essential data for the drafting of this document. Personal data will be included in a file or database of the Owner to maintain the contractual relationship and offer, extend, and improve the services provided by the Owner based on this Agreement. 5. Applicable law and jurisdiction
This Agreement is governed by Articles 1,546 and following of the Spanish Civil Code. Both parties agree to submit to the jurisdiction of the courts of the district where the property is located, expressly waiving any other jurisdiction that may apply to them. Finally, the parties declare: Their express acceptance of the entirety of the contents of this Agreement, and sign and subscribe two original copies on plain paper, with a single effect, signing these copies at the place and date indicated in the heading.
